This website is operated by Bates Display. Throughout the site, the terms “we,” “us,” and “our” refer to Bates Display. By accessing our website or purchasing from us, you agree to the following Terms of Service (“Terms”).
These Terms apply to all users of the site, including browsers, customers, vendors, and contributors of content. If you do not agree to these Terms, please do not use our website or services.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to offer our products and services online.
SECTION 1 – ONLINE STORE TERMS
By using this site, you represent that you are at least the age of majority in your state or province of residence. You may not use our products or services for any unlawful or unauthorized purpose.
You agree not to transmit any destructive code, malware, or viruses. Any violation of these Terms may result in termination of access to our services.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the website or its content without express written permission.
Headings are provided for convenience and do not affect the interpretation of these Terms.
SECTION 3 – PRODUCT INFORMATION & AVAILABILITY
We strive to ensure product descriptions, images, and specifications are accurate; however, information on this site may contain errors, omissions, or variations and is subject to change without notice.
Certain products may be available exclusively online and in limited quantities.
SECTION 4 – CUSTOM & MADE-TO-ORDER PRODUCTS
Many Bates Display products are manufactured to order or customized to customer specifications.
Variations in materials, finishes, fabrics, and dimensions are inherent in custom manufacturing and do not constitute defects.
Orders may not be cancelled once production has begun.
Customers are responsible for reviewing specifications and confirming suitability prior to ordering.
SECTION 5 – PRICING & MODIFICATIONS
Prices are subject to change without notice.
We reserve the right to modify or discontinue any product or service at any time without liability.
We shall not be liable for any modification, price change, suspension, or discontinuance of products or services.
SECTION 6 – ORDER ACCEPTANCE & BILLING
We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or violate these Terms.
You agree to provide accurate billing and account information and to promptly update information as needed.
SECTION 7 – DEPOSITS & PAYMENT TERMS
Many Bates Display products are custom-manufactured or made to order. A deposit or full payment may be required prior to production.
Deposits are non-refundable once production has begun or materials have been ordered. Submission of a deposit authorizes Bates Display to begin procurement of materials, labor allocation, and production planning.
If an order is cancelled after a deposit is received but before production begins, any refund will be issued at the sole discretion of Bates Display and may be subject to material costs, design time, administrative fees, or restocking charges.
Custom, personalized, and made-to-order products are not eligible for cancellation once approved for production.
All balances must be paid in full prior to shipment unless otherwise agreed in writing. Bates Display reserves the right to hold shipment until payment is received.
SECTION 8 – SALES TAX & RESALE CERTIFICATES
Sales tax will be applied to all orders shipped within California unless a valid resale certificate is provided and approved prior to payment.
Customers claiming tax-exempt status must submit a completed California resale certificate (CDTFA-230) that includes a valid California seller’s permit number. The resale certificate must match the billing entity on the order and be received before payment is processed.
If a valid resale certificate is not received prior to payment, applicable sales tax will be charged and collected. Bates Display is unable to retroactively remove sales tax after payment has been processed.
The purchaser is responsible for ensuring resale certificate accuracy and compliance with all California Department of Tax and Fee Administration (CDTFA) regulations. Bates Display reserves the right to reject incomplete or invalid resale certificates and may request updated documentation at any time.

SECTION 9 – PRODUCTION TIMELINES & DELAYS
Production and ship dates are estimates and may vary based on order volume, material availability, and external factors.
Bates Display shall not be liable for delays outside of our reasonable control, including supply chain disruptions, raw material shortages, carrier delays, tariffs, labor disruptions, or force majeure events.
SECTION 10 – PRODUCT USE
Bates Display products are designed for professional display and storage applications.
We are not responsible for loss, theft, or damage to merchandise displayed, stored, or transported using our products.
SECTION 11 – INTELLECTUAL PROPERTY
All content on this website, including product designs, layouts, images, configurations, and branding, is the property of Bates Display and may not be used without written permission.
Unless otherwise agreed in writing, Bates Display retains ownership of proprietary designs, tooling, engineering methods, and production processes.
Customer-provided logos and trademarks remain the property of the customer and are used solely for manufacturing purposes.
SECTION 12 – DESIGN OWNERSHIP & DEVELOPMENT WORK
All designs, renderings, layouts, prototypes, samples, specifications, and product concepts created or presented by Bates Display remain the sole intellectual property of Bates Display unless otherwise agreed in writing.
This includes sketches, CAD drawings, digital mockups, structural designs, display configurations, and material concepts developed during quoting, design, or sampling.
Designs and concepts provided by Bates Display are confidential and may not be shared with, disclosed to, reproduced by, or used with any other manufacturers, competitors, sourcing agents, or third parties without express written consent.
Submission of a quote, design, or prototype does not transfer ownership of intellectual property rights. Unauthorized use or reproduction may constitute infringement.
Design or development fees do not transfer ownership of intellectual property unless explicitly agreed in writing.
Bates Display reserves the right to reuse general structural concepts and non-customer-specific innovations unless exclusivity is agreed to in writing.
SECTION 13 – THIRD-PARTY TOOLS & LINKS
We may provide access to third-party tools or links. We are not responsible for third-party content or policies.
Use of third-party tools is at your own risk.
SECTION 14 – USER SUBMISSIONS
If you submit feedback or materials, you grant us the right to use them without restriction.
Submissions must not violate any third-party rights.
SECTION 15 – PERSONAL INFORMATION
Your submission of personal information is governed by our Privacy Policy.
SECTION 16 – ERRORS & OMISSIONS
